Copyright Society members and guests are cordially invited to join us for our 2025 International Conference in Dublin. Conference sessions will take place at the prestigious National Gallery of Ireland in Dublin. Our last international conference in Berlin in October 2023 was a highlight of our 2023-2024 programming year, and we are looking forward to another successful exchange with the copyright community in Dublin.

Cross-Border Copyright Foundations

As copyright is increasingly exploited across national borders, differences in copyright regimes across major markets can create challenges and give rise to unexpected issues for practitioners. Our international panel of experts will explore core principles of copyright law in their respective jurisdictions, including (i) copyright subsistence and thresholds of originality; (ii) authorship and ownership of copyright; (iii) term, termination, reversion, and registration; (iv) formalities and considerations relating to assignment and licensing; (v) infringement and exceptions; (vi) differing treatments of moral rights; and (v) available remedies. Through a review and comparison, this panel will provide attendees with greater insight into the treatment of core copyright principles in major international markets.

Article 17: Has the "Value Gap" Closed? Or the Internet Killed Off?

Trailed as both the “end of the internet” and as a vital improvement to the position of rights holders and creators online, article 17 was one of the most significant interventions in how copyright could and should be licensed by online intermediaries. It was also one of the most controversial pieces of copyright legislation in recent memory. Rights holders hoped it would close a “value gap” that they said had appeared in the online use of content whereas the tech communities feared there would be overblocking and a significant (nigh impossible) licensing and technical burden on them. It altered the starting position that platforms for user-generated content were not liable for unlicensed content made available on them. A newly-created category of platform (an “online content-sharing service provider”) is deemed to carry out an infringing act when it gives access to content uploaded by its users. From there it needs to obtain a licence and is liable for infringement if it does not unless it can show it has taken various steps to take get a licence and to ensure unlicensed works are not available, and to expeditiously remove and prevent further upload of infringing content when notified. This panel will explore the real-world impact of article 17 and whether the hopes and fears placed on it have come true, six years after its introduction. We will also explore whether the US community can learn anything from the legislation and practices in the EU.

AI: Ownership, Infringement and Extraterritoriality

As generative AI technologies advance, the legal questions around authorship, infringement, and regulatory reach become increasingly complex. This panel will explore how UK and EU law are responding to the challenge of determining ownership of AI-generated outputs, identifying what copyright risks may arise during training, deployment, and generation, and analysing the extraterritorial implications of the EU’s AI Act. With perspectives from leading legal experts, the discussion will offer timely insight into how copyright frameworks are adapting to one of the most disruptive technologies of our time

This panel will discuss the available tools (e.g., takedowns, customs enforcement) that IP holders have at their disposal to protect their rights when infringement occurs internationally; how enforcement may differ between industries (e.g., gaming, where user generated content is part of the model, v. more traditional industries) and also budgetary considerations in going after foreign infringements. The discussion will also touch upon AI infringements and AI technical solutions.

Copyright v. AI: The Existential Showdown (Internation Edition): Comparing US, EU, and UK Approaches to Balancing Copyright and AI Innovation

Court decisions and new laws in various jurisdictions are starting to clarify (or complicate) the legal landscape with respect to the intersection of copyright and AI. Still, much is still evolving through hotly contested policy debates about how to balance the promotion of AI innovation with the protection of copyright.  This panel will feature diverse perspectives from across AI developers and content owners who will compare and contrast the various AI policy approaches in the US, EU and UK, including with respect to application and scalable implementation of exceptions and limitations, feasibility of licensing content, model and end user liability for infringements, and the practical implications of these various policy choices. The discussion will highlight recent developments and provide insights into how various stakeholders are navigating the evolving landscape.
