This session was originally slated for the Register of Copyrights to present “A View from the Copyright Office.” In light of recent events, we’re pivoting to Plan B. The AI and fair use report that Register Perlmutter helped shepherd will now serve as the springboard for a spirited conversation about copyright in the age of generative AI. Trial by Jury: Copyright Cases At Trial

While it’s the rare copyright case that makes it all the way to a jury, they do occur. And when they do, they present a host of interesting issues. First is the question of what issues and witnesses even go to the jury. Then there is the selection of the jury, and the drafting of jury instructions and the verdict form, all of which can be outcome-determinative. There also is the issue of how to present the works at issue to the jury, which can be a matter of dispute between the parties. This panel will explore copyright jury trials and how practitioners navigate the unique issues they present.

As social media and search engines increasingly become popular means for distributing news content, tensions continue to rise between online platforms and traditional news outlets.  Recent litigations call into question content ownership and the implications of utilizing AI as a “news shortcut,” while simultaneous negotiations and licensing deals present new, potential financial frameworks.  In certain countries, governments have entered the discussion, requiring some of the largest platforms to reach equitable commercial deals with news businesses in exchange for content.  But will these policies truly enhance fairness in the digital marketplace?  This panel will explore the past, present, and future of news content, including legal and logistical challenges in protecting and enforcing intellectual property rights online, and opportunities for collaboration and innovation as the distribution and monetization of content continues to evolve.

20 Years Since Grokster

20 years ago, the Supreme Court relied on inducement to find Grokster liable for third party copyright infringement. By doing so, the Court left unanswered the precise effect of non-infringing uses on cases against distributors of technology. In the 20 years since, questions about this have remained largely unresolved. Additionally, the kinds of technologies and platforms capable of supporting infringement have multiplied. Breaking News: Fair Use Meets Artificial Intelligence: Recent Legal Developments

The intersection of copyright law and artificial intelligence has spawned at least 40 copyright infringement cases pending against AI developers in this country.  In each, the developers are relying on the defense of fair use.  AI developers have also asserted in various policy contexts that their use of copyrighted works in training AI models is fair use.  This panel will provide an update on recent developments concerning the application of fair use to AI training, including the summary judgment decision in Thomson Reuters v.
