Jury Instructions

While it’s the rare copyright case that makes it all the way to a jury, they do occur. And when they do, they present a host of interesting issues. First is the question of what issues and witnesses even go to the jury. Then there is the selection of the jury, and the drafting of jury instructions and the verdict form, all of which can be outcome-determinative. There also is the issue of how to present the works at issue to the jury, which can be a matter of dispute between the parties. This panel will explore copyright jury trials and how practitioners navigate the unique issues they present.

The Digital Divide: The Future of Consuming and Compensating for News

As social media and search engines increasingly become popular means for distributing news content, tensions continue to rise between online platforms and traditional news outlets.  Recent litigations call into question content ownership and the implications of utilizing AI as a “news shortcut,” while simultaneous negotiations and licensing deals present new, potential financial frameworks.  In certain countries, governments have entered the discussion, requiring some of the largest platforms to reach equitable commercial deals with news businesses in exchange for content.  But will these policies truly enhance fairness in the digital marketplace?  This panel will explore the past, present, and future of news content, including legal and logistical challenges in protecting and enforcing intellectual property rights online, and opportunities for collaboration and innovation as the distribution and monetization of content continues to evolve.

20 Years Since Grokster

20 years ago, the Supreme Court relied on inducement to find Grokster liable for third party copyright infringement. By doing so, the Court left unanswered the precise effect of non-infringing uses on cases against distributors of technology. In the 20 years since, questions about this have remained largely unresolved. Additionally, the kinds of technologies and platforms capable of supporting infringement have multiplied. This panel will consider the implications and influence of Grokster on third party copyright liability cases today.

Taking Copyright to the Next Level: The Future of AI that Experts are Dreaming About

The impact of artificial intelligence on copyright law and policy has been, to say the least, well covered by lawyers and technologists for the past three years. It’s now time to push the conversation forward past generative AI and into what products and technologies will look like in the next decade and beyond. This panel will explore potential copyright issues related to AI software and agents embedded into “smart” home devices, automated vehicles, self-thinking computers, self-aware robots and androids, and brain-computer interfaces allowing movies and music to be immediately accessible with just a thought. Legal issues related to copyrightability, exclusive rights, ownership, and the DMCA will be raised and addressed by an esteemed panel of lawyers, technologists, and futurists. Domo Arigato, Mr. Roboto!
