Professor David VaverDavid Vaver is Professor of Intellectual Property Law at Osgoode Hall Law School in Toronto and Professor Emeritus of Intellectual Property and Information Technology Law at the University of Oxford. He has taught intellectual property for some 50 years in Canada, New Zealand, and England, including at the University of British Columbia (1971, 1978-85), the University of Auckland (1972-78), Osgoode Hall (1985-98, 2009-present), and Oxford University (1998-2007). He was the director of the Oxford Intellectual Property Research Centre and chaired that university’s IP Advisory Group until he retired at the end of 2007. At Osgoode Hall Law School, he remains an active member of IP Osgoode, an interdisciplinary institute that explores legal issues at the intersection of intellectual property and technology.

Professor Vaver is known for his work in all aspects of intellectual property law and policy. In the field of copyright in Canada and other jurisdictions, he is acknowledged as the originator of the concept of “user rights” in addition to the traditional rights of the copyright owner. His writing transformed the balance in copyright between the interests of owners, authors, and users when the Supreme Court of Canada unanimously embraced his approach in CCH Canadian Ltd. v. Law Society of Upper Canada, a landmark decision released in 2004.

Among the many works Prof. Vaver has authored or edited is a five-volume compilation, Intellectual Property Rights: Critical Concepts in Law (Routledge, 2006), as well as Intellectual Property Law: Copyright, Patents, Trade-marks (Irwin Law, 2nd ed. 2011) and Copyright Law (Irwin Law, 2000), both of which have been cited repeatedly by Canadian courts. He also founded the Intellectual Property Journal in 1984, from which he retired as editor-in-chief in 2015 but remains on the advisory board.

In 2016, Professor Vaver was appointed a Member of the Order of Canada, the country’s highest civilian honor, for his “leadership in intellectual property law as a scholar and mentor,” and “Canada’s preeminent scholar of intellectual property law.” In 2018, he was elected as a Fellow of the Royal Society of Canada, the highest academic honor an individual can achieve in Canada in the arts, social sciences, and sciences, for his work in intellectual property law.

ABOUT THE LECTURE:
The Donald C. Brace Memorial Lecture is given in memory of the publisher Donald C. Brace, who founded Harcourt, Brace & Co. in 1919. Apart from his interest in the art of literature, Donald Brace was deeply interested in copyright legislation, the protection of creative talent, and freedom of the press. In 1950, he was awarded the Columbia University Medal of Excellence in recognition of his distinguished contributions to publishing. This series was originally established by a gift from his daughter, Mrs. Donna Brace Ogilvie.
