Please join our New York Chapter and New York University Law School’s Media Law Collaborative for a discussion on the current state of fashion law. Our panel of prominent New York practitioners and academics will explore:

  • The protections currently available to the fashion industry
  • Recent developments in copyright, trademark, design patent, trade dress, and utility patent law
  • The need for further protection and potential forms for providing it
  • Contrasting American and European approaches to fashion law
  • Whether European models offer a good alternative to existing protections

Moderator
Barbara Kolsun
is Executive Vice President and General Counsel, Stuart Weitzman LLC and an adjunct professor of law at New York University and Cardozo Law School. Ms. Kolsun started the first in house legal department at Stuart Weitzman, a luxury shoe company. Prior to her position at Stuart Weitzman, Ms. Kolsun was a Senior Vice President and General Counsel at Seven For All Mankind, LLC and Kate Spade, LLC. She served as Assistant General Counsel at WestPoint Stevens, Inc., and Calvin Klein Jeanswear Co. Ms. Kolsun co-authored Fashion Law – A Guide for Designers, Fashion Executives, and Attorneys (Fairchild Books), the first textbook on Fashion Law, with Guillermo Jimenez. She has served as Chairman of the Board of International AntiCounterfeiting Coalition and has done pioneering work in the anticounterfeiting field, speaking and publishing widely on the topic. Ms. Kolsun is an adjunct professor of law at New York University School of Law and the Benjamin N. Cardozo School of Law. She received her J.D. from Benjamin N. Cardozo School of Law and her undergraduate degree from Sarah Lawrence College.    

 

Panelists
Guillermo Jimenez
is a professor of international trade and fashion law at the Fashion Institute of Technology. Previously, he served as a Head of Division at the International Chamber of Commerce (ICC) Headquarters in Paris where he managed an international committee of experts which draft the rules governing letters of credit and Incoterms. Mr. Jimenez has taught at the University of California – Berkeley, the Ecole Superieure de Commerce de Lyon, and the Institute for International Management (Paris). He received his J.D. from the University of California – Berkeley, and his undergraduate degree from Harvard University.

 

Marc Misthal, a principle at Gottlieb, Rackman & Reisman, P.C., specializes in trademark and copyright litigation and prosecution, as well as domain name and Internet issues. He has recently contributed an extensive chapter on intellectual property to Fashion Law – A Guide for Designers, Fashion Executives, and Attorneys. He has also contributed to Trademark Counterfeiting, an Aspen Law & Business treatise. He is the author of “Reigning in the Paparazzi.”

 

Charles Colman is the founder of Charles Colman Law, PLLC, an acting assistant professor of lawyering at New York University School of Law and an adjunct professor at New York University. Charles Colman Law, PLLC, represents individuals and companies in the fashion, music, art, film, media, and new technology industries. Mr. Colman previously served as the Co-Chair of the Fashion Design Legislation Subcommittee at the American Bar Association. He has spoken and published widely on fashion law and maintains a blog, LAW OF FASHION. He received his J.D. from Columbia University School of Law and his undergraduate degree from Yale University.

 

Theodore Max is a partner and member of the Entertainment, Technology and Advertising and Intellectual Property group at Sheppard, Mullin, Richter & Hampton LLP, where he focuses on intellectual property issues consultation and litigation. He has lectured and published widely on intellectual property issues. Mr. Max received his J.D. from New York University School of Law, where he served as the Editor-In-Chief of the New York University Review of Law and Social Change, and received his undergraduate degree from Hobart College.

 

Rayna S. Lopyan is an associate in Debevoise & Plimpton LLP’s Intellectual Property & Media Litigation group. She has experience litigating IP disputes in the fashion industry, and has worked with fashion houses Kate Spade, Prada, and Yves Saint Laurent. Ms. Lopyan received her J.D. from Columbia University School of Law, where she was a Harlan Fiske Stone Scholar and a member of the Columbia Business Law Review.
