Session 2: Section 1201: Twenty-five years of TPMs, Triennial Rulemakings, and Tractors

Twenty-five years ago, Congress enacted Section 1201 to encourage markets for copyrighted works in the digital environment. Part of Section 1201 directs the US Copyright Office to engage in a rulemaking every three years to grant exemptions to the prohibitions on circumventing TPMs to allow noninfringing uses of copyrighted works. Panelists will discuss the history of the eight triennial rulemakings that have occurred so far, including trends in exemptions being granted and how the process itself has evolved. Section 1201 is not without criticism, and panelists will also discuss legal challenges to the law and the rulemaking process, focusing on Green v. DOJ, which resulted in a recent DC Circuit decision rejecting a First Amendment challenge. Finally, panelists will discuss the “right to repair” movement and its intersection with copyright law generally and Section 1201 specifically. Location: Grand Ballroom

Designed by the legendary architect Richard Morris Hunt, The Breakers mansion is Newport’s most palatial summer residence. Built from 1893-1895, at a cost of $7 million (equivalent to over $150M today), this National Historic Landmark was the summer home of Cornelius Vanderbuilt II. In addition to exploring the mansion, Copyright Society guests will get a private tour of the underground tunnel, boiler room and basement of The Breakers! You’ll see and learn about the development of electricity and how it changed the Gilded Age, plus what it took to operate the 70-room mansion. Please note: This is an underground experience and you will pass through enclosed spaces. The Beneath the Breakers tour is not handicap accessible. Comfortable, flat shoes are recommended. William Vanderbilt built Marble House as a 39th birthday present for his wife Alva Vanderbilt. It was a social and architectural landmark that set the pace for Newport’s subsequent transformation from a quiet summer colony of wooden houses to the legendary resort of opulent Gilded Age mansions. Location: 24 Person Limit. Meet in the hotel lobby at 3:00pm for 3:30pm tour (90 minutes).

Optional Activity: Rail Explorers Tour

A rail explorer is a pedal powered vehicle that rides on railroad tracks. They have four steel wheels, hydraulic disc brakes, pedals for each seat, and are comfortable, fun and easy to ride. Although the rail explorers require pedaling, the magic of steel wheels on steel rails makes the experience very different from riding a bicycle. There is no need to steer and riding is hands free – making it easy to take photographs as you roll along. Rail explorers are available in double or quad (4) seats. Shuttle service to/from provided. Please Note: Comfortable, close-toed shoes required. Riders must be able to get on and off bikes. Tour is run rain or shine, and umbrellas/ponchos will be provided if there is rain. The shuttle leaves at 2:30pm to make a 2:50pm checkin; the Rail Explorers tour starts at 3:00pm. Session 4: Copyright Across Borders

An international panel of experts will explore the ways in which copyright laws in the UK, EU and China can create unexpected issues for US practitioners. In all industries copyright is increasingly exploited on an international basis but the laws that apply in major international markets often differ from the US in significant ways, creating implications for cross-border transactions and disputes. Our panel will examine the practical impacts of these differences, including in relation to (i) copyright subsistence (open vs closed list of protected subject matter, differing thresholds for originality), (ii) ownership in the absence of the work made for hire concept, (iii) restrictions on and formal requirements for assignments and licensing, (iv) restricted acts and infringement, (v) alternative defences to fair use, (vi) differing treatments of moral rights, (vii) mandatory contractual safeguards for creators, and (viii) available remedies. Session 6: Ethical Issues Arising in the Mediation Context

We bet you’ve never asked whether you face ethical challenges in mediations unlike the challenges you face in other negotiations. Well, lawyers, we’re here to tell you that you do! Do you delegate responsibility for face-to-face negotiation to a “caucus-only” mediator? That might breach your ethical duty to represent your client competently.
