Frenemies: Collaboration and Conflict between Content Creators and Digital Platforms Using Music to Attract a Crowd SPEAKERS: Wayne Josel is the Senior Vice President, Business & Legal Affairs at the American Society for Composers, Authors and Publishers (ASCAP), the nation’s leading performing rights organization. With more than 850,000 members representing more than 16 million copyrighted works, ASCAP is the worldwide leader in performance royalties, service and advocacy for songwriters and composers, and the only American performing rights organization (PRO) founded and governed by its writer and publisher members. In his role, Wayne has primary responsibility for negotiating and structuring license agreements with a broad spectrum of music users, including broadcast and cable television networks, cable television system operators, satellite television and radio system operators and digital service providers. Prior to joining ASCAP in 2013, Wayne spent over 20 years in private practice representing companies in connection with a wide range of legal and policy issues arising out of the convergence of technology, entertainment and media, and intellectual property. Wayne received his law degree from Fordham University, where he was an editor of the Fordham Law Review. He has a BA in Political Science from Union College and an MSJ from the Medill School of Journalism at Northwestern University. Wayne lives in Mamaroneck, NY with his wife, Leslie. In his spare time, he is a drummer, avid concert goer, and yoga enthusiast.Elizabeth Moody is a Partner, Chair of New Media practice at Granderson des Rochers. Her practice includes advising digital media companies, record labels, music publishers and technology companies, including a number of live streaming platforms, gaming companies, social media sites and fitness and mindfulness companies. Prior to re-joining private practice, she served as the VP of Global Content Partnerships at Pandora, and Head of Music Partnerships at YouTube. Before her business practice, Moody helped to build Davis Shapiro’s digital media practice, advising digital media services through years of shift in the digital music and video industries. She started her career as a lawyer at Paul Weiss Rifkind Wharton & Garrison LLP. Moody received a J.D. from the Washington College of Law at American University and a B.A. in International Studies and French from Colby College. Vickie Nauman specializes in the intersection between technology and music, focused on licensing, relationships and music rights; helping grow companies from point A to point B; and global strategic development. She is Founder and CEO of the boutique consulting and advisory firm CrossBorderWorks and has an ambitious portfolio of forward-thinking companies in gaming, tech, consumer electronics, finance and music since 2014. A digital music pioneer, Nauman worked on licensing and product for one of the first legal digital services MusicNet (RealNetworks JV), led strategic partnerships for connected device company Sonos, started and ran the US business for global music platform 7digital, and did digital music business in Europe and China as a consultant. She built one of the first DMCA-compliant services at taste-making Seattle station KEXP and has an MBA through the London School of Economics, NYU-Stern, and HEC-Paris, in the executive program TRIUM. She is an advisor to companies in M&A, strategic growth, and early stage startups in music/tech. Client base includes Beat Saber/Oculus, AimLab, SoundExchange, Feed.fm, VSCO, Downtown Holdings, Spotify, Warner Music Group, and more listed on LinkedIn.Judith Finell (Moderator) is a musicologist and has served as an expert witness and consultant in many music copyright disputes throughout the U.S. and abroad. She joined the UCLA faculty in 2019, and teaches the only course on forensic musicology in the country. She also advises film, television, advertising, media and tech companies on a wide variety of music topics, including digital sampling, music rights, infringement, and public domain. In addition to testifying in many notable copyright trials over the past two decades, she was the testifying expert for the Marvin Gaye estate against Pharrell Williams in the “Blurred Lines” trial in Federal District court, and also before the Copyright Royalty Board on behalf of the National Music Publishers Association regarding ringtones. She presides over Judith Finell MusicServices, a music consulting firm in Los Angeles and New York with a team of musicologists advising attorneys and their clients on music copyright issues. Judith Finell was honored to be the commencement speaker at the UCLA Herb Alpert School of Music in 2018.
