Copyright, Right of Publicity and College Athletes This panel will address the intersection of copyright and right of publicity law, specifically focusing on recent developments that permit student-athletes to profit from their Name, Image and Likeness (NIL). Although student-athletes can now enter into sponsorship deals and profit from their NIL, they still may be prohibited from using other IP owned by their schools, such as team logos as well as copyrighted materials, which may include team photos, game footage and uniforms. Could copyright limit athletes’ ability to fully enjoy the value of their NIL? The Complex Role Between Copyright And Censorship Copyright law has steadfastly avoided taking sides when it comes to controversial works. The Copyright Office refuses to take a moral stance during registration, and courts have repeatedly recognized that copyright law does not invite content-based discrimination. Elements of the public on occasion revert to burning books, protesting explicit music, and morally condemning sexually expressive films. However, copyright law has remained impartial, giving value to important content which may be deemed unacceptable by often vocal parties. Unfortunately, this hasn't stopped some attempts to use copyright law as a tool of censorship to contain ideas. From DMCA takedown notices aimed at silencing critics to the politics behind podcasts and the unusual outcomes of controversial lyrics, this panel will explore the intersection of copyright law and censorship, with an eye towards actionable solutions aimed at ensuring copyright continues to promote, and not limit, creative works and ideas. Among other protections, the Treaties require Member States to vest authors with the exclusive right to communicate their literary and artistic works to the public, including by authorizing the “making available” of their works (and phonograms and embodied performances) through interactive and on-demand platforms from which individuals choose where and when they want to access them. The “making available” right was intended to help copyright owners control the release of copyrighted material on the Internet and crack down on digital piracy. The United States concluded that the right was already covered by existing exclusive rights, whereas Canada and other countries in Europe opted to implement it through the communication right. But years after implementation, what does the right to make a work available mean for copyright owners and users navigating mature but complex digital markets? How have U.S. and foreign courts applied the making available obligation? Have other countries reached a harmonized interpretation of the nature and scope of the right? The full picture of how courts will interpret and apply the “making available” right is still evolving. From hyperlinking to other emerging issues, however, our panel offers expert insights. Web. 2.0 was "read-write" (you can write content, but you can't do much with it). Web 3.0 ("Web3") promises something new: the ability for each of us to read, write, and control our content. Technological advancements seem to herald the new age, with disintermediation in various forms: DAOs (decentralized autonomous organizations), blockchain, cyber currencies, NFTs (non-fungible tokens), and generative art. Each of these mechanisms promise to put content control in creators' hands. But they also open new perils to curious yet untaught audiences. One of the biggest mysteries to new entrants in Web3 is how intellectual property rights are sorted, exchanged, negotiated, and otherwise managed. In this panel, we explore both the promises and the perils of copyright in the Web3 universe and take a practical look at how to develop expertise as counsel in these cutting-edge areas.
