Anti-SLAPP statutes, passed to curb lawsuits aimed at expressive activity, have been a powerful tool in the world of traditional media. A number of states have recently passed or are considering passing anti-SLAPP laws in the face of this success. But these statutes’ effect in the entertainment law context is less than clear. For example, a recent Ninth Circuit decision held that California’s anti-SLAPP statute could not be used to address an “idea submission” claim. Moreover, state anti-SLAPP laws do not address federal claims such as copyright and trademark infringement. Plaintiffs’ attorneys and some courts are pushing back in general on the applicability of anti-SLAPP statutes.

Join us to hear a distinguished panel discuss and debate these issues. David Aronoff of Fox Rothschild will be the moderator. David has litigated anti-SLAPP matters at the trial and appellate level for two decades.  Ben Sheffner of the Motion Picture Association of America will discuss his travels around the U.S. addressing various state legislatures that were considering passing anti-SLAPP statutes as well as his efforts to help get passed through Congress a federal anti-SLAPP statute that would cover copyright claims.  Neville Johnson of Johnson & Johnson is a noted, talented and passionate plaintiff’s lawyer who has confronted the anti-SLAPP statute many times, including recently in the Richard Simmons versus National Enquirer case. He will address the “anti-anti-SLAPP” perspective!  Don’t miss what will assuredly be a lively discussion of a topic vastly important to the media/entertainment/intellectual property community.
