ABOUT THE PROGRAM:

Copyright trolling is certainly not popular, and it may or may not be profitable, but is it ethical?  Is it ethical to represent individual photographers and seek to recover small (but perhaps meritorious) settlements from corporate defendants by using the threat and cost of litigation as leverage?  Is it ethical to represent corporate pornographers against individual “John Doe” downloaders/infringers by threatening to publicly expose the individuals in a lawsuit if they do not settle? 

Come on down and join us—in game show format!—for an exciting discussion of these and other ethical issues in copyright.

The Copyright Society of the USA is a New York State and Pennsylvania certified CLE provider. The program will offer 1 NY and 1 PA CLE ethics credit.

PANELISTS:

Bruce Green
Fordham Law School

Bruce A. Green is the Louis Stein Chair at Fordham Law School, where he directs the Louis Stein Center for Law and Ethics. He teaches and writes primarily in the areas of legal ethics and criminal law, and is involved in various bar association activities. Currently, Professor Green chairs the NYC Bar Association’s Committee on Professional Ethics, the ABA Criminal Justice Standards Committee, and the Multistate Professional Responsibility Examination drafting committee, and is a member and past chair of the NY State Bar Association’s Committee on Professional Ethics. He previously chaired the ABA Criminal Justice Section, served on the ABA Standing Committee on Ethics and Professional Responsibility, was the Reporter to both the ABA Task Force on Attorney-Client Privilege and the ABA Commission on Multijurisdictional Practice, and co-chaired the ethics committee of the ABA Litigation Section and Criminal Justice Section.  Since joining the Fordham faculty in 1987, Professor Green has engaged in various part-time public service, including as a member of the NYC Conflicts of Interest Board, as a member of the attorney disciplinary committee in Manhattan, as Associate Counsel in the office of the Iran/Contra prosecutor, and as a consultant and special investigator for the NYS Commission on Government Integrity.  Previously, Professor Green was a federal prosecutor in the Southern District of New York, where he served as Chief Appellate Attorney, and he was a judicial law clerk to Justice Thurgood Marshall and Circuit Judge James L. Oakes.  In May 2018, Professor Green received the Michael Franck Professional Responsibility Award, given by the ABA Center for Professional Responsibility.

Linda Steinman

Linda Steinman has more than 30 years of litigation and counseling experience in media and intellectual property law, and First Amendment law.She represents a wide range of clients in media and the arts, including book publishers, television production companies, networks, nonprofits, and digital media. Her cases involve defamation, privacy/publicity, copyright, trademark, newsgathering torts, reporter’s privilege, prior restraint, and other publishing law and First Amendment issues. Linda also regularly provides counseling advice to media clients, NGOs, and other nonprofits and universities, including pre-publication and pre-broadcasting review of publications, television shows (including reality programming), and documentaries, as well as complex fair use analyses. Linda also works with clients on intellectual property rights acquisition.

Rob Potter (Host)
Kilpatrick Townsend & Stockton

Rob Potter is an IP litigation partner at Kilpatrick Townsend & Stockton LLP.  Rob’s practice is centered around trademark and copyright litigation and counseling, with an emphasis on anti-counterfeiting and internet infringement. He routinely litigates disputes in courts around the country and before the Trademark Trial and Appeal Board, and advises clients on intellectual property matters across a wide range of industries including entertainment, luxury goods, and technology. Rob also has experience in obtaining and enforcing temporary and preliminary injunctive relief in trademark and anti-counterfeiting matters. Rob received his J.D. cum laude from the University of Pennsylvania Law School and is active in various professional associations, including the Copyright Society of the U.S.A and the International Anti-Counterfeiting Coalition.  Rob is an enormous music fan and lives in Brooklyn with his wife and two children.
