The Supreme Court will soon decide a case on an important copyright issue that has divided lower courts for the last several years: when and how the aesthetic features of a useful article become eligible for copyright protection. In Star Athletica v. Varsity Brands, the question is centered around designs that are part of uniforms for cheerleaders, but the potential impact of this case will certainly be felt far more widely, as the Court attempts to resolve a complicated doctrinal issue for the future.
