Spiders and Scraping and Bots, Oh My! — Datanomics, Copyright, and Legal Liability When: October 27, 2014 at 12:00pm - 2:00pm EDT - This event has passed Please join us for a New York Chapter Lunch at the Princeton Club in Midtown Manhattan.This panel will look at the implications of the intersection of big data and data mining with copyright-related principles, including DMCA restrictions and fair use. The discussion will cover the legal landscape and assess whether certain ways of using data may have legal implications. Speakers: Jonathan Askin is a professor at Brooklyn Law School, where he teaches courses in technology, telecommunications, and entrepreneurial law and policy. He is the Founder of the Brooklyn Law Incubator & Policy Clinic, which represents Internet, new media, communications and technology entrepreneurs, startups, innovators and organizations in matters relating to business development, policy advocacy and legal reform, and the “Innovation Catalyst” for the newly established Brooklyn Law Center for Urban Business Entrepreneurship. Jonathan is also a Visiting Professor at the Queen Mary University of London School of Law, a Fellow at the Columbia Institute for Tele-Information, an Adjunct Professor at Columbia Law School, and a Founder and Advisor of iLINC, a network of legal support clinics for the European startup community. Jonathan previously chaired the Internet Governance Working Group for the Obama 2008 Presidential Campaign, and has served on the boards of many communications and Internet industry consumer groups. Jonathan obtained his Bachelor of Arts degree with honors from Harvard University and his J.D. with honors from Rutgers Law School. Joseph V. DeMarco is a partner at DeVore & DeMarco LLP where he specializes in litigating and counseling on complex issues involving information privacy and security, theft of intellectual property and computer intrusions. From 1997 to 2007, he was an Assistant U.S. Attorney for the Southern District of New York, where he headed the Computer Hacking and Intellectual Property Program, supervising prosecutions of cybercrime cases affecting e-commerce and critical infrastructures. He is an Adjunct Professor at Columbia Law School, where he teaches Internet and Computer Crimes. He holds a J.D. from N.Y.U. Law School and B.S.F.S. from Georgetown University. Dana Rosen is the General Counsel at Wenner Media. In this role, she is responsible for all legal matters for Us Weekly, Rolling Stone and Men’s Journal magazines, and all corporate legal matters for Wenner Media. At Wenner, she counsels clients on a wide variety of issues, including copyright and trademark law, defamation, licensing, privacy, rights of publicity and consumer protection. She is responsible for all pre-publication legal vetting of editorial content and oversees all claims and litigations. She also oversees all contracts and the legal aspects of all corporate transactions and partnerships, including all digital initiatives such as the magazine websites, digital editions and apps, and all film and television projects. Prior to Wenner Media, she was an Associate General Counsel at Penguin Group (USA), and prior to that was an associate with the firm Paul, Weiss, Rifkind, Wharton & Garrison LLP. She also served as a judicial clerk to the Honorable Shira A. Scheinlin in the United States District Court for the Southern District of New York. She graduated from New York University of Law. Moderator: Robert Potter is an associate on the Trademark and Copyright team at Kilpatrick Townsend and Stockton LLP. He focuses his practice on trademark and copyright litigation and counseling, with an emphasis on anti-counterfeiting and Internet infringement. Mr. Potter routinely litigates disputes in state and federal courts around the country and before the Trademark Trial and Appeal Board, and advises clients on intellectual property matters across a wide range of industries including entertainment, luxury goods, and technology. He has successfully represented clients in a broad array of copyright and trademark matters, including successful oral argument before the Second Circuit in affirming a summary judgment victory for client, Sony Pictures Entertainment. Mr. Potter was recognized as a New York “Super Lawyer” in 2014 and 2013 for Intellectual Property Litigation by Super Lawyers magazine.
