An Adventure into Dark Corners of the Copyright Act




ABOUT THE PROGRAM:

From time to time, Congress has inserted into the Copyright Act some unexpected items: provisions for boat hull designs, video game rentals, concert bootlegs.  Do you even know what a semiconductor chip mask work is? Are any of these provisions even constitutional?  We’ve assembled a crackerjack panel of wonks and nerds to shed light on these dim corners of the Act.

PANELISTS:

Joshua Graubart is an experienced counselor and advocate whose practice focuses on the entertainment, media, and technology industries.Josh advises a wide range of clients in connection with copyright, trademark, entertainment and advertising matters at home and abroad. He has represented a German advertiser in securing the services of a top American recording artist in promoting the client’s consumer products in Europe, a European online music service in connection with its entry in the the U.S. market, and a Fortune 500 biotechnology company in negotiating new advertising and marketing agreements with its media and creative vendors.
In 2012, he represented the buyer of a multinational cosmetics concern in connection with its acquisition, and in 2008 and 2009, he led the lender’s legal team in two multi-billion dollar loan transactions in evaluating and protecting the borrowers’ intellectual property collateral, and oversaw the recording of the lender’s security interests more than twenty countries, including some where such recording had never before been attempted. He regularly advises independent artists, authors, and creative entrepreneurs in connection with protecting and exploiting, and licensing intellectual property, including copyrights, trademarks, patents, and other sources of royalties and residuals.
In addition, Josh is an accomplished litigator who has handled numerous contract and intellectual property disputes on behalf of major international cosmetics makers, industrial products manufacturers, technology companies, venture capital investors, and independent writers, artists, publishers and record labels. In the past few years, he has successfully represented three classes of copyright holders in federal court, achieving settlements totaling almost US$10 million. In 2007 and 2008, he represented a South American energy consortium in international arbitration concerning cross-border natural gas sales and transport agreements valued at more than US$100 million. He regularly appears on behalf of corporate and individual clients in litigation in state and federal court in New York and New Jersey and in arbitration and mediation proceedings concerning intellectual property, rights of privacy and publicity, and general commercial disputes. Full Bio.

 

June Besek is the executive director and lecturer in law of the Kernochan Center for Law, Media and the Arts at Columbia Law School. She teaches a seminar on authors, artists, and performers. Besek also co-teaches, a seminar on current issues in copyright. Before joining Columbia in 1999, Besek was Director of Intellectual Property at Reuters America Inc. She was formerly a partner at Schwab Goldberg Price & Dannay, where she focused on copyright, trademark, and other legal issues. Besek is the chair of the copyright division of the American Bar Association’s intellectual property section, and also chairs the section’s copyright reform task force. Besek serves on the editorial board of the Journal of the Copyright Society of the U.S.A. and the board of advisors of the Columbia Journal of Law and the Arts. She clerked for Judge Charles H. Tenney in the Southern District of New York. Besek earned her J.D. from New York University in 1981 and received her B.A. from Yale.

  


Bill Rosenblatt
is a globally recognized authority on technology issues pertaining to intellectual property in the digital age.  He has contributed to standards initiatives related to content identification, metadata, and rights.  Bill has served as an expert witness in litigations related to copyright, digital content and security technologies, in federal court and before the Copyright Royalty Board and the PTO.  He has testified before and advised public policy entities on digital copyright and technology issues on three continents.Bill is author of the book Digital Rights Management: Business and Technology (Wiley), technical books published by O’Reilly, and several whitepapers, book chapters and journal articles on technologies related to digital media and copyright. He writes the blog Copyright and Technology and is a media and entertainment contributor to Forbes. In addition to the Copyright and Technology Conferences that Bill chairs, he has been an invited speaker at many conferences, including the World Economic Forum (Davos) and other events worldwide. He has been quoted in periodicals in eight countries and has appeared on ABC News and on National Public Radio. Prior to founding Giantsteps in 2000, Bill was Chief Technology Officer of Fathom, a knowledge destination web site for lifelong learners backed by Columbia University, the London School of Economics, and other scholarly institutions. Bill defined Fathom’s content and e-commerce technology architecture and built its technology infrastructure.

 

Joshua Simmons is a Partner at Kirkland & Ellis. He focuses his practice on intellectual property, including copyrights, patents, publicity rights, trademarks, and trade secrets. His practice includes litigation and counseling, as well as regulatory and legislative policy. He also advises clients on intellectual property matters that intersect with antitrust, computer and Internet fraud, false advertising, privacy, and social media issues, along with contract, licensing, and domain name disputes. In addition to maintaining a full-time litigation practice, Mr. Simmons is a frequent speaker—including guest lectures at Harvard Law School, Columbia Law School, and Northwestern University—and has authored numerous articles on emerging trends in intellectual property. He is an active member of the ABA Intellectual Property Law Section, chairing its Copyright Law Reform Task Force and serving on its Council, as well as being the immediate past chair of the Copyright Division. He also is an adviser to the Uniform Law Commission’s Right of Publicity Study Committee, and a member of the Copyright Society of the USA’s Advisory Board. In addition, he is an appointed member of the IPO Software Related Inventions Committee, and the INTA Internet Committee. He was part of the Kirkland team that was honored by Managing Intellectual Property magazine for its work on “Milestone Case of the Year” Oracle America v. Google. He also is a member of the York Theatre Company’s board of directors. He received a J.D. from Columbia Law School, where he was awarded the Carroll G. Harper Prize for achievement in intellectual property, and a B.A. from Brandeis University.
