PANELISTS

Paul Fakler is a Partner at Orrick Herrington & Sutcliffe LLP, where he works at the intersection of music, technology and business. He draws upon two decades of copyright, computer, and music industry expertise to help streaming, media and software companies advance their business. Although he assists clients with issues relating to many different types of content, Paul has especially deep experience in the music industry as it has adapted to fundamental changes brought by digital media. As music evolves into a cutting-edge digital industry, those businesses require an equally innovative legal approach. Paul offers creative ways to adapt copyright laws to the latest technology, through litigation, counseling and government relations. He has devoted his practice to this unique field, as well as to handling software copyright litigation, a natural fit given his experience as a copyright lawyer, former software developer and amateur musician.

He has litigated numerous high-profile copyright cases involving digital media, copyright and the Internet. He routinely represents digital music services, as well as other media and software companies, in negotiations and disputes with record labels, music publishers, and other rights holders. His clients in these ground-breaking cases have included MP3.com, Yahoo!, Veoh, MediaNet, Sirius XM Radio, Bill Graham Archives, and Music Choice. Paul also has significant experience handling copyright royalty rate-setting proceedings, including proceedings before the Copyright Royalty Board and the American Society of Composers, Authors and Publishers (ASCAP) and Broadcast Music, Inc., (BMI) rate courts. He obtained the only two royalty rate reductions ever granted by the Copyright Royalty Board (or its predecessors).

Erika Stallings works as an attorney at Broadcast Music, Inc (BMI) where she handles all legal issues relating to BMI’s affiliated songwriters and publishers including copyright transfers, copyright infringement litigation, copyright termination, estates and bankruptcies. She also advises BMI’s distribution, administration and creative departments on day-to-day legal issues. Ms. Stallings is a 2010 graduate of Georgetown University Law Center and a 2007 graduate of the University of North Carolina-Chapel Hill which she attended as a Morehead-Cain Scholar.

Joshua Graubart (Moderator) is an experienced counselor and advocate whose practice focuses on the entertainment, media, and technology industries.Josh advises a wide range of clients in connection with copyright, trademark, entertainment and advertising matters at home and abroad. He has represented a German advertiser in securing the services of a top American recording artist in promoting the client’s consumer products in Europe, a European online music service in connection with its entry in the the U.S. market, and a Fortune 500 biotechnology company in negotiating new advertising and marketing agreements with its media and creative vendors. In 2012, he represented the buyer of a multinational cosmetics concern in connection with its acquisition, and in 2008 and 2009, he led the lender’s legal team in two multi-billion dollar loan transactions in evaluating and protecting the borrowers’ intellectual property collateral, and oversaw the recording of the lender’s security interests more than twenty countries, including some where such recording had never before been attempted. He regularly advises independent artists, authors, and creative entrepreneurs in connection with protecting and exploiting, and licensing intellectual property, including copyrights, trademarks, patents, and other sources of royalties and residuals.

In addition, Josh is an accomplished litigator who has handled numerous contract and intellectual property disputes on behalf of major international cosmetics makers, industrial products manufacturers, technology companies, venture capital investors, and independent writers, artists, publishers and record labels. In the past few years, he has successfully represented three classes of copyright holders in federal court, achieving settlements totaling almost US$10 million. In 2007 and 2008, he represented a South American energy consortium in international arbitration concerning cross-border natural gas sales and transport agreements valued at more than US$100 million. He regularly appears on behalf of corporate and individual clients in litigation in state and federal court in New York and New Jersey and in arbitration and mediation proceedings concerning intellectual property, rights of privacy and publicity, and general commercial disputes. Full Bio.
