Postponed: Beg Forgiveness or Ask Permission? Navigating Copyright Licensing Issues

In the digital age, understanding the licensing of copyrighted content is more relevant than ever in pursuits ranging from entertainment to education and software to social media. As the internet continues to evolve and our use of copyrighted content along with it, it is increasingly important to both rightsholders and content users to understand the mechanics of copyright licensing, fair use, and the balance between the two. This panel will evaluate the scope of copyright licensing in our online world, examining the tension between content users “begging permission” through obtaining a license, or risking the need to “ask forgiveness” by staking their use on fair use grounds.

SPEAKERS:

Laura Burtle – Associate Dean, Georgia State University Library

Laura Burtle is an Associate Dean in the Georgia State University Library, with responsibility over collections, resource acquisitions, digital library services, and scholarly communications. She provides copyright guidance to students and faculty, including teaching about fair use and permissions as well as understanding publication contracts and open access. She has a Master’s degree in Library Science from the University of North Carolina Chapel Hill and a J.D. from Georgia State University with a certificate in Intellectual Property Law. 

Andrew Pequignot – Member, Moore Pequignot LLC

Andrew Pequignot is a member of Moore Pequignot LLC, an entertainment and intellectual property boutique firm in Atlanta, Georgia, where he focuses his practice on copyright, trademark, and entertainment matters. He is a frequent writer and speaker and has lectured at Emory University and Georgia State University. He served on the committee that drafted the pattern jury instructions for copyright cases in the Eleventh Circuit, and he formerly co-chaired the Southeast Chapter of CSUSA and chaired the copyright committee of the IP Section of the State Bar of Georgia. He has been recognized as a “Super Lawyer” in Intellectual Property by Super Lawyers magazine and as among The Best Lawyers in America for IP Litigation and Trademark Law. Before joining Moore Pequignot LLC, Andrew was an attorney with Kilpatrick Townsend & Stockton LLP.

Jake Phillips – Shareholder, Greenberg Traurig, LLP

Jake Phillips is a Shareholder in the Entertainment and Media Group at Greenberg Traurig, LLP. His practice focuses on transactional entertainment matters, with a particular emphasis on the intersection of music and technology.
