ABOUT THE PROGRAM:

The widespread and common practice of embedding photos and other content from social media online—previously considered by many to be a non-infringing act—was put into question last year by a New York court’s holding that embedding can be copyright infringement.  

How has this ruling affected the legal landscape for use of photos and other works online, and how have companies’ online and social media policies and practices changed in response?  What other issues surrounding the use of online content keep online writers and media and legal professionals up at night?

Drew Shenkman, Senior Counsel – Cable News Network

Drew Shenkman is Senior Counsel with Cable News Network in Atlanta, serving as a newsroom attorney. Drew works with CNN journalists in the U.S. and around the world providing prepublication advice and counseling on content and newsgathering, including advice on access to information under state and federal law. Prior to joining CNN, Drew was an associate in the Washington, D.C. office of Holland & Knight on the firm’s media litigation team. Drew received an undergraduate, masters of mass communications, and a law degree from the University of Florida. He is also an active participant in the American Bar Association Forum on Communications Law and the Media Law Resource Center, and is on the Atlanta Press Club’s Board of Directors.

Elizabeth Wheeler, Senior Counsel – UPtv

Liz Wheeler is Senior Counsel at UP Entertainment, LLC and is primarily responsible for supporting the development and production of scripted series and the acquisition of films and series for the UP network. In addition, she works extensively with the network’s digital and marketing teams, and handles litigation matters and UP’s domestic and international trademark portfolio. Previously counsel at Turner Broadcasting System, Inc., Liz began her legal career as an associate with an Atlanta-based entertainment and intellectual property boutique, counseling clients on general copyright and trademark matters, as well as recording contracts, literary publishing agreements, film and television production deals, consignment and commission agreements for visual artists, and pre-publication clearance.

James Trigg, Partner – Kilpatrick Townsend & Stockton LLP

James Trigg practices in the areas of trademark, copyright and entertainment law. His intellectual property experience includes litigation, licensing, trademark prosecution, and general trademark and copyright counseling. His practice has developed a particular focus on copyright and trademark issues arising in the context of the Internet, including matters implicating the Digital Millennium Copyright Act, domain name disputes and social media. James has represented major companies, as well as recording artists, in music copyright litigation, and he also has advised an array of entertainers and creators on domestic and international trademark and branding issues. A former professional musician, James regularly draws on this background when litigating music copyright cases and in negotiating licenses both for artists and for parties desiring to use musical works in advertising and in other contexts.
