KATHERINE B. FORREST

“Copyright Law and Artificial Intelligence: Emerging Issues”

Until very recently, Katherine B. Forrest served for seven years as a federal judge on the U.S. District Court for the Southern District of New York. In that time, she presided over several thousand cases, including more than 100 complex and high-profile trials. She authored more than 1,000 opinions, and sat by designation on the Second Circuit for over three-dozen appeals. She has been and will continue as an Adjunct Professor of Law at New York University, co-teaching a course on Quantitative Methods and the Law.

Ms. Forrest has returned to private practice at Cravath, Swaine & Moore LLP where she practiced as a litigator from 1990-2010. During that time, she had a diverse practice representing clients in a variety of matters, particularly in the areas of antitrust, intellectual property, digital media, and general commercial law. In 2010, Ms. Forrest was named Deputy Assistant Attorney General for the Antitrust Division at the Department of Justice, where she oversaw operations for criminal and civil enforcement, and then in 2011 President Obama nominated her to serve as a district judge.

Among Ms. Forrest’s copyright decisions during her tenure on the S.D.N.Y. were Jetmax Ltd. v. Big Lots, Inc., No. 15-CV-9597 KBF, 2017 WL 3726756 (S.D.N.Y. Aug. 28, 2017) (an early application of the Supreme Court’s decision in Star Athletica, LLC v. Varsity Brands, Inc., 137 S. Ct. 1002 (2017), on the copyrightability of useful objects); Nobile v. Watts, 17-cv-597 (KBF), 2017 U.S. Dist. LEXIS 170525 (S.D.N.Y. Oct. 16, 2017) (granting motions to dismiss claims of copyright infringement against the film and novel, The Light Between Oceans), aff’d, No. 17-3752, 2018 U.S. App. LEXIS 27058 (2d Cir. Sept. 21, 2018) (summary order); and Goldman v. Breitbart News Network, LLC, 302 F. Supp. 3d 585 (S.D.N.Y. 2018) (holding that embedding links to Goldman’s photograph infringed his display right and questioning the rationale of the 9th Circuit’s Perfect 10 Server Test). In July 2018, the 2d Circuit declined defendants’ petition for leave to appeal.

About the Lecture

The Donald C. Brace Memorial Lecture is given in memory of the publisher Donald C. Brace, who founded Harcourt, Brace & Co. in 1919. Apart from his interest in the art of literature, Donald Brace was deeply interested in copyright legislation, the protection of creative talent and freedom of the press. In 1950, he was awarded the Columbia University Medal of Excellence in recognition of his distinguished contributions to publishing. This series was originally established by a gift from his daughter, Mrs. Donna Brace Ogilvie.
