Tracking technologies and reverse image software has equipped copyright holders with the ability to better monitor unauthorized use of their content. Join us for a panel-led discussion on what practitioners are seeing in terms of settlement demands and negotiating tactics when dealing with rights holders’ organizations, individual creators and “trolls.”

Jenevieve J. Maerker, Counsel, Foley Hoag

Jenevieve Maerker focuses her practice on helping companies both large and small to develop and protect their intellectual property assets. She has extensive experience in domestic and international trademark strategy, including selection, clearance, registration, policing, and licensing of marks and other brand assets. Jenevieve also litigates trademark, trade dress, and copyright infringement and ownership disputes in federal court and handles opposition and cancellation proceedings before the United States Trademark Trial and Appeal Board.
Jenevieve’s intellectual property experience spans a broad range of industries, including pharmaceuticals, medical devices, financial services, high-tech, and consumer products. Her clients include companies at every stage of development, from innovative start-ups to established multinational corporations.

Andrea J. Mealey, Partner, FisherBroyles

Andrea’s practice is focused on the acquisition, registration, enforcement and monetization of clients’ intellectual property, including trademarks, copyrights, domain names, trade secrets and other non-patented assets.
Andrea began her legal career as a legal manager, researching trademark availability and enforcement actions for a leading athletic footwear and apparel company. In addition to private practice, she worked in house at a world renowned toy and entertainment company on licensing and music matters. Andrea’s varied background directs her practice philosophy – the World Trademark Reporter Top 1,000 list of IP practitioners noted in 2015 about Andrea that, thanks to her stint on the other side of the client/attorney relationship, she knows exactly what brand owners want and how to deliver it.
Andrea assists her clients in building the value of their intellectual property by counseling clients on domestic and international trademark selection and prosecution, copyright registration, trade secret policies and processes, domain name acquisition and portfolio management, non-disclosure agreements, and transactional due diligence and support. She understands that intellectual property assets should deliver value to their owners and helps clients monetize their intellectual property assets through licensing, promotional agreements and co-branding arrangements.
