Copyright and Collaborative Works

Please join us on September 24th for a review of this past summer’s most important copyright cases from the Second and Ninth Circuits on copyright rights in collaborative works, includingGarcia v. Google and 16 Casa Duse v. Merkin.  Our panelists will review the impact of these cases on defining what a “work” is for purposes of copyright and present hypotheticals that test the limits of what these new decisions teach us. The panelists will also address how your contracts may need to adjust to these new cases.

Patrick W. Guy is the former Senior Vice President of Business Affairs at Scripps Networks Interactive (whose brands include Food Network, HGTV, DIY Network, Travel Channel, Great American Country, Cooking Channel), and is now a transactional attorney representing both talent and media companies. For ten years, Pat was the principal sports lawyer at CBS, followed by eleven years as the General Counsel to Lifetime Television and fourteen years as the head of Business Affairs for SNI.

David Leichtman is a partner in the trial practice of the New York office of Robins Kaplan LLP.  He founded the New York office of the firm in 2010 with two other partners in order to expand the firm’s national trial practice and capabilities. David has tried a variety of complex matters in federal and state courts around the country. The types of matters he handles include patent, copyright, trade secret and trademark cases, as well as other kinds of business litigation involving antitrust, contract, fraud, and other business torts. He has significant experience in a variety of industries, and his work also involves monetization of IP portfolios. David also serves as the Chair of the Board of Directors of Volunteer Lawyers for the Arts, as the co-Chair of the Inventor of the Year Committee of the New York Intellectual Property Law Association, and as a member of its Patent Litigation Committee, as well as a member of the IPO Committee on Copyright and Anti-Piracy Law (where he served as Vice-Chair until 2014).  He is a fellow of the Litigation Counsel of America, a highly selective trial lawyer honor society, and has been named a New York “Super Lawyer” in Intellectual Property Litigation (2010-2015). David holds a BA from the University of Michigan (1990), an MA from Hunter College (1993), and a JD from Columbia Law School (1996).

Stan Richardson is a playwright and formed the
company The Representatives Present, Inc. with actor Matt Steiner. 
Since 2012, The Representatives Present, Inc. has presented 13 new
works, ranging from their signature apartment plays (one of
BroadwayWorld.com’s “Top 10 Theater Experiences of 2012”) to larger
pieces including two film-theater hybrids; a site-specific adaptation of
a Russian epic; and a residency at IRT Theater to work on a project
with deaf artists. The Representatives’ dedication to presenting work
as soon as it’s written – in people’s homes and other unconventional
spaces – has created an underground following committed to
hyper-intimate, socially relevant theatrical experiences. Their
film-theater hybrid works, including the recent play Beddy Tear, raise
issues addressed by the recent case law.

Jedd Wider is a documentary film producer and writer known for Taxi to the Dark Side (2007), Mea Maxima Culpa: Silence in the House of God (2012) and Client 9: The Rise and Fall of Eliot Spitzer (2010). In his day job, he is a partner at Morgan Lewis, where he is co-head of the Firm’s global hedge funds practice, representing leading financial institutions, fund managers, and institutional investors.
