Wes Earnhardt

Wes Earnhardt is first-chair trial and appellate lawyer who is consistently at the forefront of critical litigation that shapes both industries and the law.  He regularly represents clients in high-stakes commercial disputes, including in patent and copyright litigation.  Most recently, Mr. Earnhardt argued and won a U.S. Supreme Court decision for music producer Sherman Nealy holding that a copyright owner may recover damages under the Copyright Act for any timely filed infringement claim, regardless of when the infringement occurred.  The Court’s decision in Nealy’s favor resolved an issue that had divided the Circuit Courts.
