Marc Toberoff is the founding partner of Toberoff & Associates, and a leading attorney in the area of copyright and entertainment litigation.  Called the “legal Man of Steel” and a “superhero to rights holders” by Variety, and a “brilliant crusader for the little guy” by The New York Times, Mr. Toberoff is a relentless, dedicated advocate of creators’ rights. Mr. Toberoff has successfully represented numerous high-profile clients in a wide variety of intellectual property and entertainment transactional matters, ranging from the children of James Brown and Ray Charles, respectively, to the heirs of Jerry Siegel, Superman’s co-creator, of Jack Kirby, the artistic genius behind most Marvel superhero franchises, and of Steve Ditko, creator of Spiderman.  Mr. Toberoff is currently lead counsel for Elon Musk in the matter of Musk v. Altman (N.D. Cal) concerning OpenAI’s profiteering abuse of its charitable form–set for trial commencing April 27, 2026.

Variety has named Mr. Toberoff to its 2024 “Legal Impact Report,” in recognition of Hollywood attorneys “well-equipped to make award-winning wins for their clients.” The Report goes on to say that “In the ongoing challenge of defending and enhancing the rights of writers and artists in the stories and characters they have created, Toberoff is a dedicated advocate”.

Mr. Toberoff was also named to the Hollywood Reporter’s “Power Lawyers 2024: Hollywood’s Top 100 Attorneys” spotlighting “the entertainment industry’s most powerful legal advocates.” According to the report, “Toberoff has forged a path as the leading advocate for creators’ rights in intellectual property.”

Consistently, in 2008-2012, Mr. Toberoff was included in The Hollywood Reporter’s “Power Lawyer” list, comprised of the most influential entertainment and media attorneys in the country.  In 2009, Mr. Toberoff was similarly honored by Variety as a top entertainment Dealmaker.  In 2010, Mr. Toberoff was listed by Forbes magazine as one of the “Seven Most Powerful People in Hollywood.”  Also in 2010, Mr. Toberoff was featured by the Los Angeles Business Journal in a special report on the top entertainment lawyers.
