Joe Gratz is a Partner in the San Francisco office Morrison & Foerster. His practice focuses on litigation related to copyright and new technologies. Joe recently prevailed at trial on behalf of Redbubble in a trademark case brought by Atari, and at the Ninth Circuit on behalf of Facebook in a copyright case. He currently represents Instagram in a Ninth Circuit appeal regarding the copyright consequences of embedding social media posts on other websites. Joe defeated a preliminary injunction motion made against a start-up UpCodes, which sought to the public posting of state and local building codes in which a private party claims copyright. And he is defending nonprofit library Internet Archive in litigation brought by four major publishers, arguing that it is fair use to digitally loan library books to one patron at a time. He represented Google in the Google Book Search case.
