Elaine K. Kim is a partner in the Entertainment & IP and Litigation practice groups at Mitchell Silberberg & Knupp LLP. Ms. Kim specializes in commercial litigation and counsel, with an emphasis on intellectual property and entertainment matters. Ms. Kim has represented major motion-picture and television studios, video game companies, record companies, and individual creators and producers in cases and matters involving copyright, trademarks, trade secrets, idea submission, right of publicity, and defamation. In her defense of numerous studios and creators against claims that their television series or films infringed the plaintiff’s copyright, Ms. Kim has often litigated the issue of substantial similarity. Ms. Kim is involved in various organizations, including as a Trustee of the Los Angeles Copyright Society, Copyright Planning Committee co-head for the USC Gould School of Law Intellectual Property Institute, Board member of the Constitutional Rights Foundation, and Emeritus Board member for the Asian Pacific Community Fund. She is also involved in the firm’s Diversity, Equity, and Inclusion Committee.
