I routinely represent large and sophisticated clients in novel copyright, trademark, and right of publicity disputes. I have achieved good results as lead trial counsel on bet-the-business copyright and trademark matters involving a variety of solutions that were unthinkable when the disputes commenced. I work heavily in the e-commerce and software spaces and am at home managing cases involving parties that have data, not documents. I have succeeded in leveraging technological tools and my understanding of the digital space to weaken opponents’ positions in disputes and appetites for the fight. To name a few examples in just the past few years, I defeated a Copyright Act plaintiff at trial in the Central District of California; forced and collected on a large settlement against an allegedly defunct company and its counterfeiting owner in the Middle District of Florida in a Lanham Act and Patent Act case; obtained a draw from a jury in the Western District of Kentucky on a Lanham Act and defamation case for a client that was both the defendant and counterclaimant; and, without any confidentiality attached, persuaded two separate Copyright Act and Lanham Act plaintiffs (Atari Interactive, Inc. and Canvasfish, LLC) to walk away from a expensively litigated lawsuits in the Central District of California and Western District of Michigan. I am also a member of the International Trademark Association and an active member of its Right of Publicity Committee.
