“Embedded” Issues: Using Linked and Embedded Content from Social Media (POSTPONED)

ABOUT THE PROGRAM:

Embedding social media content into other mediums—like articles or other platforms—is an increasingly popular way to share photographs and videos. Platforms like Instagram make embedding easy by building that function into their interfaces, but users shouldn’t be lulled into thinking that embedding doesn’t carry legal risks. Our expert panel will explore the rapidly evolving landscape of copyright risks associated with social media linking and embedding, including a review of several recent cases and best practices for both publishers and content owners.

James Rosenfeld is a partner in Davis Wright Tremaine’s New York office. He litigates for and counsels digital and traditional media clients on risks and claims relating to their content. His matters span media, intellectual property, and internet law – including copyright, trademark, defamation, right-of-publicity, invasion of privacy, freedom of information law, reporter’s privilege, and commercial matters. He has particular expertise in digital media law, advising clients on issues unique to content providers on the internet, including the DMCA and CDA legal immunities for user-generated content; liability arising from linking, sharing, distributing, embedding, moderating, and aggregating content; and issues relating to online advertising, social media, artificial intelligence, and piracy. Mr. Rosenfeld is a graduate of Yale University (’90) and Columbia Law School (’95) where he was named a Harlan Fiske Stone Scholar. He is recognized by Chambers USA as a leading practitioner in the Media & Entertainment Litigation category and by Thomson Reuters as a “New York Super Lawyer.”
