The Raging Bull Decision (Almost) One Year Later: Copyright Limitations & Laches

On May 19, 2014, the U.S. Supreme Court issued an opinion that weakened the laches defense to copyright infringement and breathed new life into a lawsuit over the 1980 film Raging Bull that the defendant argued was filed 18 years too late. Now, in less than a year’s time, the effects of the “Raging Bull” decision – Petrella v. Metro-Goldwyn Mayer, Inc., 134 S.Ct. 1962 (2014) – are being seen in the revival of copyright cases that were thought to have been dead, as well as in the context of trademark and patent litigation.

Stevie Fitzgerald, a staff attorney with The Authors Guild in New York City, which submitted an amicus brief to the U.S. Supreme Court in Petrella, and Amber Lee Hagy, an IP litigator from the Austin office of Greenberg Traurig, LLP, will discuss this important copyright decision and its effects, as well as the time-based copyright infringement defenses of limitations and laches.

Stevie Fitzgerald (The Authors Guild, New York, NY): Stevie Fitzgerald is a Staff Attorney at the Authors Guild in New York City, where she advises creators in all aspects of intellectual property law, including aiding members in contract negotiations, interceding in royalty and rights disputes, and supervising issues involving the Digital Millennium Copyright Act. She is also involved in the ongoing litigation surrounding the Google Books technology and has organized multiple Amicus Curiae briefs to the U.S. Supreme Court. Stevie manages all intellectual property left to the Authors Guild and has negotiated and structured all deals for the exploitation of these rights. Stevie is a native Austinite who, prior to attending William & Mary School of Law, received her undergraduate degree in English Literature from St. Edward’s University. She is co-author of the 4th edition of Business and Legal Forms for Authors and Self-Publishers to be released by Allsworth Press on June 2, 2015.

Amber Lee Hagy (Greenberg Traurig, LLP, Austin, TX): Amber Lee Hagy is a Shareholder with the Austin office of Greenberg Traurig, LLP. She focuses her practice on patent dispute litigation for a variety of technologies, including computer software, electronics, semiconductors and digital telephony. She is experienced with motion practice, trial preparation, and briefing at both the trial and appellate levels. Amber is a Registered Patent Attorney with the U.S. Patent and Trademark Office. She received her J.D., with high honors, from The University of Texas School of Law, and her B.S., with honors, in Electrical Engineering from The University of Texas at Austin. She is listed in The Best Lawyers in America for Litigation – Patent, and is listed as a Texas Super Lawyer.
