Developments in Secondary Copyright Liability

ABOUt THE PROGRAM

We have come a long way since the Grokster and YouTube decisions started transforming the landscape of secondary copyright liability doctrine. In recent years, there have been further refinements to the DMCA, including the Copyright Office’s study of § 512 and new lawsuits commenced against Amazon and Vimeo for their alleged roles in fostering copyright infringement. Most recently, the district court decision in BMG v Cox could affect ISPs’ processes for handling copyright complaints, and the EU Court of Justice’s decision on hyperlinking in GS Media v Sanoma may have a profound impact on the global enforcement of copyrights on the Web. This program will survey recent developments in secondary copyright law and bring everyone up-to-date on this evolving area.

SPEAKERS

Andrew P. Bridges has 25 years of complex litigation experience in copyright, trademark, advertising, trade secret, consumer protection, unfair competition, licensing, and other commercial law disputes. In addition, Mr. Bridges is a strategic advisor to entrepreneurs and companies on their branding and trademark portfolios. He also oversees the management of global portfolios and the coordination of foreign litigation matters for innovators and companies around the globe.

Before joining Fenwick & West, Mr. Bridges was a partner and Vice Chair of the firmwide Intellectual Property practice at Winston & Strawn. From 1991 to 2004, he headed the Trademarks and Advertising Practices Group at Wilson Sonsini Goodrich & Rosati. In 2008, he was listed as one of the top 100 lawyers in California, and since then he has been repeatedly ranked among the top 75 or 100 IP litigators in California. He has rankings in Band 1 for Intellectual Property—Trademark, Copyright, and Trade Secrets by Chambers USA and in Band 1 for California (one of only two individuals at that level) and in Band 2 nationally for Trademark Litigation by World Trademark Review, is listed in The International Who’s Who of Trademark Lawyers, Best Lawyers in America and in “Best of the Best” by Legal Media Group (for trademark law), and has been honored in a variety of other publications relating to e-commerce and intellectual property law. Mr. Bridges was also named an IP Star in Managing Intellectual Property’s 2014 and 2015 editions. The Daily Journal named Mr. Bridges as one of the “Top Intellectual Property Attorneys” in 2014 and 2015.

Hillel I. Parness is a highly-experienced commercial litigator and trial attorney. Over the course of his career, Hillel has represented a broad spectrum of domestic and international companies and individuals in a variety of industries. His clients have included major financial institutions, rapid-growth and technology-leveraged enterprises, and large entertainment and media companies. In particular, Hillel has substantial experience assisting clients with issues arising from the intersection of emerging technology, media and the Internet, as well as matters arising from the complex business activities of both traditional and Internet-based businesses.

His prior experience includes serving as Acting Head of Litigation for Warner Music Group Corp. (2014), Partner at Robins, Kaplan, Miller & Ciresi L.L.P. (2010-2014), and Partner at Lovells LLP (now Hogan Lovells) (2006-2010). Hillel also serves on the Adjunct Faculty of Columbia Law School, where he has been teaching Internet and intellectual property topics since 2002. He is frequently called upon for his views on issues relating to complex litigation, intellectual property and the Internet, and he is a regular writer, speaker and commentator on these issues.

 

Stanley Pierre-Louis is Senior Vice President and General Counsel for the Entertainment Software Association (ESA). In that capacity, Stan leads the legal,policy and regulatory affairs function for the organization,which includes advocacy on First Amendment, technology and intellectual property issues; supervision of a global content protection program; and responsibility for contractual matters. Stan also oversees all governance and compliance matters for the organization and serves as Corporate Secretary to ESA’s Board of Directors.

Prior to joining ESA, Stan served as Senior Vice President and Associate General Counsel for Intellectual Property and Content Protection at Viacom.There, he was responsible for developing strategies to protect digital content, managing major intellectual property litigation and revamping its cybersecurity governance program. Earlier in his career, Stan was Senior Vice President for Legal Affairs at the Recording Industry Association of America. There, he led several strategic copyright litigations, including the entertainment industry’s litigations against MP3.com, Napster and Aimster as well as the landmark U.S. Supreme Court case MGM Studios v.Grokster, which resulted in a unanimous decision in favor of the film and music industries. Stan has also worked in private practice and served as a judicial law clerk to Judge David A. Nelson of the U.S. Court of Appeals for the Sixth Circuit.

Stan is a Phi Beta Kappa graduate of Clark University and earned his law degree from the University of Chicago Law School, where he served on the Board of Editors of the University of Chicago Law Review.

 

Bill Rosenblatt is president of GiantSteps Media Technology Strategies, a consulting firm. GiantSteps’ clients include content providers and digital media technology companies, ranging from early stage startups to multinationals, as well law and public policy entities and investment firms worldwide. Bill brings content providers strategic expertise in areas such as digital copyright technologies, content management and distribution, and content business models. He advises technology vendors on market strategy, business development, product management, and IP monetization. He has helped design a global standard intellectual property identifier as well as digital rights management schemes for music and e-books.

Before founding GiantSteps in 2000, Bill held technology management positions in the publishing industry as well as digital media market strategy and consulting roles in the computer industry, and he was the CTO of an e-learning startup at Columbia University. He began his career as a software engineer in data communications at Motorola. Bill is author of the book Digital Rights Management: Business and Technology (Wiley, 2001), technical books published by O’Reilly & Associates, and several whitepapers, book chapters and journal articles on technologies related to digital media and copyright. He has spoken at conferences on five continents and has guest lectured on digital copyright at various universities and law schools.

Bill has degrees in computer science from Princeton and the University of Massachusetts. He is a trustee of WPRB-FM, the student-run commercial radio station at Princeton. He is a member of the Book Industry Study Group, the Open Music Initiative, and the Copyright Society of the USA.
